1. Acceptance of Terms

By accessing or utilizing the services provided by Mizanul Islam or operated under the parent brand Grow Up ("Company", "we", "us", "our"), including our web software, performance media buying, server-side tracking (CAPI) infrastructure, WhatsApp API tools, and strategy consultation sessions, you agree to be legally bound by these Terms of Service.

If you do not agree to these terms, you must refrain from accessing our tools, booking consultations, or engaging our performance growth services.

2. Scope of Services

Grow Up provides specialized growth engineering and performance marketing services, including but not limited to:

• Paid Media Buying & Management (Meta Ads, TikTok Ads, Google Ads).
• Server-Side Conversions API (CAPI) setup & Cloudflare Workers architecture.
• Funnel Conversion Rate Optimization (CRO) & Direct Response Copywriting.
• WhatsApp Cloud API automation and messaging integration.
• Private 1-on-1 strategy consultation and growth audits.

3. Client Responsibilities & Ad Account Access

To enable service delivery, clients must provide necessary administrative permissions to Meta Business Managers, Google Ads accounts, Google Tag Manager containers, and server environments (where applicable).

• Clients maintain sole responsibility for all direct ad spend billed by third-party ad networks (Meta, Google, TikTok).
• Clients guarantee that all products, services, or offers promoted comply with applicable advertising policies and international laws.
• Clients must ensure that their destination websites possess legally compliant Privacy Policies regarding user tracking and cookie usage.

4. Intellectual Property Rights

All proprietary tools, custom tracking scripts, sGTM configurations, software templates, and educational assets engineered by Mizanul Islam remain the intellectual property of Grow Up unless explicitly transferred via a written custom agreement.

Clients are granted a non-exclusive, non-transferable license to utilize configured server-side pipelines and custom funnels for their active business operations during the engagement period.

5. Payments, Billings & Refunds

Consultation fees, monthly performance agency retainers, and tracking pipeline setup fees must be settled according to the agreed invoice schedules.

• Consultation Calls: Strategy consultation fees are non-refundable once the 1-on-1 session has been completed. Rescheduling is permitted up to 12 hours prior to the booked slot.
• Agency Retainers & Setups: Service fees cover custom engineering labor and strategy time. Refunds are processed according to our official Refund Policy.

6. Limitation of Liability

In no event shall Mizanul Islam, Grow Up, or its team members be held liable for any indirect, incidental, or consequential damages, including loss of ad account access, temporary site downtime, or platform policy suspensions executed by third-party providers (e.g., Meta, Google, WhatsApp) beyond our direct control.

7. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Bangladesh. Any disputes arising from or in connection with these terms shall first be attempted to be resolved through good-faith direct negotiations.

8. Amendments to Terms

We reserve the right to modify or update these Terms of Service at any time. Changes will take effect immediately upon publication on this page. Continued use of our website and services signifies acceptance of the updated terms.
